The controversial rezoning plan known as CodeNEXT is now being studied by the City of Austin’s powerful Planning Commission, which reviews matters related to land use and development. There’s only one problem: The Planning Commission is itself illegal.

According to our voter-approved city charter, no more than one-third of the commission’s members may be connected to land-development industries. The law was put in place to prevent developer interests and land speculators from shaping our land policy for their own benefit.

Our planning commission has violated that law since 2015. The commission’s chairman, all of its officers, and a majority of its members are land developers, architects, and others with professional ties to real estate. The Council and Mayor have failed to fix this violation for three years.
